1. Scope of Marketing Services

The Marketing Steps provides performance marketing, Meta Ads management, social media content, YouTube optimization, and search engine consulting. Deliverables, timelines, and payment structures are explicitly outlined in individual client agreements or invoices.

2. Marketing Disclaimer & No Guarantee of Revenue

CRITICAL NOTICE: Marketing performance relies on external marketplace dynamics, third-party platform algorithms, client sales response speed, product/course pricing, and regional competition. While we implement industry-leading growth frameworks, we do not guarantee specific batch enrollments, fixed profit figures, or exact return on ad spend (ROAS).

3. Third-Party Platform Policies (Meta & Google)

  • Advertising campaigns are subject to the independent policies of Meta Platforms, Inc. and Google LLC.
  • The Marketing Steps is not liable for account suspensions, ad disapprovals, or algorithmic platform outages imposed by Meta or Google.
  • Ad Spend: Unless otherwise specified in writing, all platform ad spend is paid directly by the client to Meta/Google and is separate from agency management fees.

4. Client Responsibilities

To ensure optimal campaign performance, the client agrees to:

  • Provide accurate course materials, logos, faculty information, and admission details in a timely manner.
  • Follow up with inbound leads promptly (ideally within 15 minutes of submission).
  • Ensure all promoted content complies with Indian consumer protection and educational advertising standards.

5. Intellectual Property

All strategies, website code, design frameworks, and agency marketing materials displayed on this website are the intellectual property of The Marketing Steps. Custom creatives produced for paid client engagements transfer to client ownership upon full settlement of invoices.

6. Limitation of Liability & Indemnification

In no event shall The Marketing Steps, its founder, or affiliates be liable for any indirect, incidental, punitive, or consequential damages resulting from ad performance, client sales closing rates, or platform outages. The client agrees to indemnify and hold harmless the Agency from any third-party claims arising from client-provided promotional claims.

7. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with our services shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra, India.
